Divorce Petition
To end a marriage or civil partnership relationship a party must petition the court to pronounce that the marriage/civil partnership is ended. Since the introduction of no fault divorce in April 2022, there is no longer any requirement to have grounds for a divorce.
Once the petition is issued by either or both parties together there is a 20 week wait before an application can be made for a conditional order. During this time the parties have the opportunity to resolve the side issues relating to the relationship breakdown including finances, children etc. An application can then be made for the conditional order to be made final without the necessity to attend court in person.
It is usual to delay the application for the order to be made final until the finances of the marriage have been sorted out.
Both the finances and the petition can take place simultaneously.
